Terms and Conditions

Welcome to Christian's Fitness Factory (CFF). CFF offers products and services to you when you visit our store at cffstrengthequipment.com. When shopping at CFF, whether the order is placed over the phone, in-store, or via the website, you agree to the following terms and conditions. Please read them carefully and contact us if you have any questions.

 

Taxes

Taxes are charged on orders that are shipped to states where we are required by law to collect tax and remit it to that state. For those states we do not collect sales tax, you may be responsible for reporting your purchase and paying sales tax directly to your state.

 

Products

Unless otherwise indicated in the listing (such as used cardio equipment), all CFF products are brand new, undamaged, and never been used.

CFF retains ownership of any products ordered until full payment has been received for such products. While CFF attempts to make 100% certain that all product colors, dimensions, and photos are exact, there are at times minor discrepancies based on screen resolution, and other possible factors. Any questions or hesitations based on color or dimensions must be discussed before placing your order. CFF will not be responsible for minor discrepancies from what was advertised.

Product Listing Errors

We do not warrant that product descriptions or other site content are accurate, complete, reliable, current, or error-free. Prices and promotions are subject to change. Rarely an item listed as available on our site may not be available, or an item may be mispriced, despite our best efforts. For any of these reasons, we may cancel your order, or we may contact you for instructions on the order.

 

Origins and Processing Time

CFF Brand Products

Most CFF brand products ship from either our PA location or our AZ location. While we try to have everything in stock in both locations, CFF makes no guarantee the item you ordered will be shipped from the closer warehouse.

In-stock items are typically processed and shipped within one business day of placing your order but can take 3 or more business days.

Non CFF Brand Products

Some non CFF brand items are drop shipped from the manufacturer. This usually means it will take a few extra days to process your order. CFF cannot be responsible or liable for delays that occur after the order with the manufacturer has been placed. Drop shipped products can originate from anywhere in the US depending on the manufacturer.

 

Orders

Canceling

To cancel an order, a customer must contact us by phone. Since orders are typically shipped in less than 24 business hours, we cannot guarantee that we will receive cancellations through other means, such as email, before they are shipped. Orders are not cancelled until confirmed by CFF.

Shipments originating out of CFF warehouses that have not yet been handed over to the shipping carrier may be cancelled for a full refund. Cancellation of shipments with origins other than CFF warehouses cannot be guaranteed and may be subject to restocking fees.

Cancellation of an order or item from an order that has already been handed to the carrier will be subject to our Return Policy.

To cancel a Legend Fitness order, a customer must contact us by email. Orders are typically placed into production within 24 business hours from the time of purchase or the customer will be subject to a 25% restocking fee. This is a vendor policy we have no control over and cannot be waived. 

To cancel a custom Regupol Flooring order, a customer must contact us by email. Orders are typically placed into production within 24 business hours from the time of purchase or the customer will be subject to a 25% restocking fee. This is a vendor policy we have no control over and cannot be waived. 

To cancel a custom order for used equipment, a customer must contact us by email within 72 Business hours upon paying for the order. A Customer who wishes to cancel an order after the allotted time will be subject to a 25% restocking fee. This is due to the cost we will incur due to the cancellation of the order. After 72 hours the equipment will have already shipped or arrived at at our facility. This is a vendor policy we have no control over and it will not be waived. 

Order Errors

We strive to make sure your order is shipped correctly but on occasion, we make a mistake. If you receive your order and what you received is not what you ordered, you must report it to us within 5 days from delivery. We are not responsible for order errors after 5 days.

 

Shipping

Shipping Methods

CFF uses a variety of shipping methods including:
  • US Postal Service (USPS)
  • FedEx
  • UPS
  • LTL Freight
CFF chooses ship carriers and methods at it's sole discretion.

Shipping Transit Time

CFF does not guaranteed delivery dates. Typical transit time after the order has been handed to the carrier is 1 to 5 days, but can be longer.

Additional shipping on Freight and International Shipments

While we try to provide accurate shipment quotes on our website, shipments outside of the lower 48 United States and any shipment that will be shipped via a freight carrier will require additional shipping charges beyond the total cost of your cart. In the event this is true, CFF will contact you via phone or email and let you know how much the additional shipping is. At that time you may pay the fees or you may cancel your order for a full refund. 

Freight Shipments

Geographical Limitation

Some residential addresses are not accessible by LTL freight carriers. This may be due to terrain, road weight limits, or space requirements, among other reasons. CFF is not responsible for additional freight carrier charges that arise out of requesting delivery to an inaccessible address. The customer will be responsible for arranging an alternative drop off point and any transport costs associated with transporting the order from the new drop off location to the originally requested location.

Delivery Appointments

When we book any freight, we always request "Contact before delivery". Trucking companies consider this a "best effort" request and does not guarantee that the driver will call before delivery. We have no control over what the driver does, we can only submit this request when we book the freight. You will need to be present for delivery at the time appointed by the trucking company. CFF is not responsible for any charges or losses incurred by missed appointments by the customer or the trucking company.

Shipment Unloading

The trucking company will drop your shipment off at the curb. Unless you have arranged for and paid extra for "Inside Delivery", you are responsible for moving the freight from the curb to where you need it. The driver is under no obligation to move, or help move, the freight except as required to get it off the truck to street level. Any request of the driver to do so will incur additional charges that you will be billed for. Pallets could weigh up to 2500lbs so have plans on how you will move it prior to the delivery, which may require manually offloading the pallet an item at a time.

Delivery Changes and Damage

Any changes to the delivery must go through CFF and may be subject to additional fees. We insure your equipment at full replacement cost, but you need to be vigilant at delivery time. Thoroughly document any damage, real or potential, keeping in mind you have every right to decline delivery of obviously damaged equipment. Additional information about handling damaged shipments is attached to every freight shipment. There is also additional information in the next section. Please call us with any questions, however small.

 

Damaged Shipments

CFF makes every feasible effort to make sure that your order arrives to you in perfect condition the first time. However, despite taking extreme precautions protecting the shipments, damages may occur on rare occasions. Customer agrees to allow CFF, and/or our shipping agent the opportunity to remedy the damage or defected issue. Said resolution will be at no cost to the customer. Customer agrees to accept the remedy selected by CFF or the shipping agent.

Any items damaged during shipment must be reported to CFF within 1 business day of delivery (as indicated by the tracking number) or 10 days from shipment, if no tracking information is available, whichever comes first. It is the customer’s responsibility to provide, within 4 business days of the request, any documentation that CFF requires to facilitate the process of filing a claim with the carrier. This may include, but not limited to providing pictures of the item, pictures of the packaging, and signed affidavits. Failure to do so will revoke your right to file a claim and release CFF from any further liability.

If you suspect damage during shipment

If possible, tell the delivery driver that you wish for them to note that the item appears damaged, take pictures of the unopened package and open the package in the presence of the driver. DO NOT DESTROY THE PACKAGING WHEN OPENING OR DISCARD THE PACKAGING AFTER IT’S OPENED. It is important to keep any evidence of damage.

If the product is damaged:

  1. Go to https://cffstrengthequipment.com/pages/contact-us
  2. Fill out the form providing your order number, address, and a description of the damage
  3. If you have pictures of the damage, please attach them.
  4. Select “Order Problems” Department and click submit.

This will create a ticket in our Helpdesk which will allow you to track your claim as well as provide additional information as needed. In almost all cases we will ask for pictures of the damage which can be attached to a Helpdesk reply. Please provide in focus pictures that show the damage detail as well as wider shots showing the damage. Blurry pictures will be rejected. As per our terms, any request for information must be complied with within 4 business days or your claim will be denied.

Once we have the information we need, CFF will file a claim with the carrier. Claim processing time varies by carrier, but can take upwards of several weeks. At CFF’s sole discretion, we may resolve the issue using one of, but not limited to, the following actions: a new item will be sent, the damaged part of an item will be sent, or compensation for the damage, of an amount determined by CFF, in the form of a refund or store credit will be issued.

The damaged item may need to be returned to CFF. If requested, you must ship the item within 5 business days of notification. Failure to do say may incur additional charges up to the full value of the damaged item.

 

Return Policy and Procedures

Hassle Free Returns

We want our customers’ experience to be great no matter what the situation is, so CFF offers HASSLE FREE RETURNS! If you are not 100% satisfied with your purchase, return an item within 30 days and get a full refund upon return. (See terms and conditions below)

If you wish to make a return

The following procedure is only valid for items purchased at christiansfitnessfactory.com or cffstrengthequipment.com. Items purchased on eBay or Amazon must be returned in compliance with their respective policies and procedures. CFF cannot directly process returns for items purchased on eBay or Amazon outside of their respective return procedures.

Returned items will not be accepted without an RMA number. To get an RMA number:

  1. Go to https://cffstrengthequipment.com/pages/contact-us
  2. Fill out the form providing your order number, address, and a description of what you wish to return, as well as why you wish to return it
  3. Select “Order Problems” Department and click submit.

This will create a ticket in our Help-desk which will allow you to track your return as well as provide additional information as needed. An RMA number will be issued within 2 business days after submitting the form.

Please include your RMA number on any returned packaging or it will delay your refund.

Hassle Free Returns Terms & Conditions

Most items may be returned for an exchange or refund up to 30 days after the item has been delivered (as indicated by the tracking number).

All sales are final on special order items like climbing ropes, rolled rubber flooring, Eleiko, and Legend Fitness. These items are built to order, therefore they are not returnable under any circumstances.

Non CFF Brand items like York Barbell, Elieko, Uesaka, Body Solid, Wright, Troy, Cap, CSN, Keiser, etc., are not included in free returns. These items may be returned,  but the customer is responsible for the cost of shipping the item both ways. The original shipping cost will be deducted from any refund issued. The return shipment must be insured for the full cost of the merchandise and will be subject to a restocking fee, deemed by the partner companies.

Used/refurbished gym equipment and any items that were shipped freight are not included in free returns. These items may be returned, but the customer is responsible for the cost of shipping of the item both ways. The original shipping cost will be deducted from any refund issued. The return shipment must be insured for the full cost of the merchandise and will be subject to a restocking fee.

It is the customer’s responsibility to get the return to the provided carrier. i.e. Fedex, UPS, USPS. On the special occasion CFF issues a return label, a CFF-issued shipping labels does not include package pickup.

All returns must include an RMA number and returned in the original packaging and in the original, like-new, resell-able condition they were received. All items returned, other than due to defect or shipping error, can be subject to a 25% restocking fee if CFF determines that the returned item is not in like-new, resell-able condition and in the original packaging. Equipment that has been assembled or partially assembled is not considered "like-new".

All returned merchandise must be packaged in a way that will ensure the item(s) will be transported without damage. CFF will not be responsible if damage occurs during shipment and the item is no longer in like-new, resell-able condition thus incurring a restocking fee.

Any items for which an RMA number was issued but the customer was unable to provide an active tracking number for the return shipment within 30 days of original item receipt, the RMA will be cancelled and CFF will no longer accept the return. The customer will be responsible for any additional shipping fees associated with the refused shipment.

A refund will be issued within 10 business days after receipt of a qualifying return. All refunds issued within 30 days of purchase will be returned onto the original form of payment. Any refunds issued after 30 days will be in the form of a store credit only.

Disputes

Any dispute or claim relating in any way to your use of any CFF products or services sold or distributed through cffstrengthequipment.com will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

As to any claim made against CFF, you agree that your damages, if any, shall, to the fullest extent permitted by law, be limited to the actual amount of money you paid to CFF for the cost of goods as well as any shipping costs you actually paid directly to CFF (but not to any third party). We do not guarantee that we will be able to fill every order and you should not expect that simply because an order is placed or an item is listed in our catalog or website, that such item is definitely available. If you place an order which we are unable to complete, then, if you have made a payment to CFF, you agree that your damages shall be limited to a refund of the amount you paid. If you did not pay for the order, you shall not be entitled to damages or to recover anything from CFF for being unable to complete an order. You agree that, in all instances, you are not entitled to, and CFF shall not be liable for, incidental, punitive, exemplary, indirect or consequential damages (including but not limited to lost profits, loss of use, damage to third parties, or any diminution of value) arising under or relating to any items you purchase, order, obtain, or seek to obtain from CFF.

If you resort to disputing or reversing a charge or submitting a dispute claim with your financial institution in an attempt to reverse or withhold payment from Christian's Fitness Factory for either a portion or the entire sum of your order, you are thereby forfeiting your rights to any promotional offers that were provided with your order.
